TEA ACT, No. 23 of 2020

THE DRAFT TEA (PAYMENTS) REGULATIONS, 2021 AND DRAFT TEA (LEVY) REGULATIONS, 2021

REQUEST FOR COMMENTS

Following the coming into effect of the Tea Act, 2020 on 11th January 2021, the Cabinet Secretary for Agriculture, Livestock, Fisheries and Cooperatives has developed draft Tea (Payment) Regulations and Tea (levy) Regulations towards operationalization of the Act.

The drafting of the regulations is the culmination of reforms aimed at addressing the challenges currently facing the tea industry with a view to re-positioning it towards sustainability and profitability.

TEA (PAYMENTS) REGULATIONS, 2021

The tea payments provide for the regulation of brokerage fee, payments to tea growers and management agreements between Tea Factory Limited Companies and Management Agents. 

TEA (LEVY) REGULATIONS, 2021

The main objective of the tea levy regulations is to impose and provide for the collection of the tea levy on exports and imports. The levy shall be utilized for development of the tea sub-sector and in particular; for income or price stabilization for tea growers, undertaking research, furtherance of the functions of the Board and for infrastructure in the tea sub-sector.

The Ministry therefore requests the public to submit their views and comments on the Draft Tea (Payments) Regulations, 2021 and the Draft Tea (Levy) Regulations, 2021 which can be accessed through the following websites: www.afa.go.ke and www.kilimo.go.ke.
